  • “Customer” refers to any individual or entity that engages the Company for services.
  1. Scope of Services

2.1 Backflow Services

  • The Company offers certified backflow prevention inspections, testing, repairs, and compliance certifications to ensure water safety and regulatory adherence.
  • Customers are responsible for scheduling required periodic inspections to maintain compliance with local regulations.

2.2 HVAC Services

  • The Company provides residential heating, ventilation, and air conditioning (HVAC) installation, maintenance, and repair services.
  • Customers must provide accurate information about their HVAC systems to facilitate proper servicing.

2.3 Service Limitations

  • The Company’s services are subject to availability, weather conditions, and access to the customer’s property.
  • The Company does not guarantee uninterrupted operation of backflow or HVAC systems due to external factors beyond its control.
  1. Scheduling and Appointments

3.1 Booking

  • Appointments must be scheduled in advance via phone, email, or the Company’s website.

3.2 Cancellations

  • Customers must notify the Company at least 24 hours before a scheduled appointment for cancellations or rescheduling. Failure to do so might result in a cancellation fee.

3.3 Access to Property

  • Customers are responsible for providing safe and unobstructed access to the service area. The Company reserves the right to reschedule if access is restricted.
  1. Fees and Payment

4.1 Pricing

  • Service fees will be communicated before the commencement of any work. Additional charges may apply for after-hours services, emergency repairs, or unforeseen circumstances requiring extra work.

4.2 Payment Terms

  • Payment is due upon service completion unless otherwise agreed in writing.
  • Accepted payment methods include cash, credit/debit cards, and electronic transfers.

4.3 Late Payments

  • Late payments may incur interest at the rate specified on the invoice or as permitted by law.
  1. Warranties and Disclaimers

5.1 Service Warranty

  • The Company warrants its work for 90 days from the date of service for labor and any parts installed, subject to manufacturer’s warranties. This warranty excludes damages caused by misuse, neglect, or external factors.

5.2 No Guarantee

  • While the Company strives for excellence, it does not guarantee uninterrupted operation or indefinite problem resolution for backflow or HVAC systems.
  1. Limitation of Liability
  • To the extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages resulting from services provided.
  • The Company’s total liability shall not exceed the amount paid by the customer for the specific service rendered.
  1. Customer Responsibilities

7.1 Compliance

  • Customers must comply with all local, state, and federal regulations regarding backflow and HVAC systems.

7.2 Property Maintenance

  • Customers are responsible for maintaining their systems and reporting any issues promptly.

8.1 Information Collection

  • The Company collects personal information such as name, address, phone number, and email for service scheduling and communication purposes.

8.2 Use of Information

  • Personal information is used to provide services, process payments, and communicate with customers regarding appointments and service updates.

8.3 Data Sharing

  • The Company does not sell or share customer information with third parties except as required by law or to facilitate service delivery (e.g., subcontractors or payment processors).

8.4 Data Security

  • The Company employs reasonable security measures to protect customer information. However, it cannot guarantee absolute data security.

8.5 Customer Rights

  1. Governing Law
  • These Terms of Service shall be governed by the laws of the State of Chapel Hill. Any disputes shall be resolved in the courts located within Chapel Hill.
  1. Amendments
  • The Company reserves the right to amend these Terms of Service at any time. Changes will be communicated via the Company’s website or directly to customers.
